These terms govern access to and use of the academIA platform operated by Río Mares S.L. By using the platform you accept these terms in full.

1. Purpose

These Terms of Use ("the Terms") govern, in full, the access, browsing and use of the academIA online maritime training platform (the "Platform"), including, without limitation, all VHF radio, radar and nautical chart simulators, the Mar_IA artificial intelligence tutor, training content, downloadable materials and any other current or future functionality incorporated into the Platform. Accessing and using the Platform implies full, express and unreserved acceptance of every clause contained herein, as well as of the Privacy Policy and any particular conditions that may apply to specific services. If the user does not agree with any of these conditions, they must refrain from using the Platform.

2. Service Description

academIA provides online training services aimed at preparing recreational and professional maritime qualifications, through interactive simulation tools (VHF radio, ARPA radar and nautical chart), adaptive exercises generated by artificial intelligence, theoretical content, practice scenarios and an automated tutoring system. The nature, scope and availability of each feature may vary depending on the plan subscribed, and the Platform may modify, expand, suspend or discontinue any of its services, in whole or in part, whenever it deems appropriate for technical, operational or commercial reasons, without this giving rise to any right to compensation in favour of the user, without prejudice to the rights they may hold under applicable consumer legislation.

3. Access & Registration

Access to certain Platform features requires prior registration by the user, providing a valid email address and, where applicable, other identifying information requested in the corresponding form. The user guarantees the accuracy, veracity and currency of the information provided and undertakes to keep their access credentials confidential, being solely responsible for any activity carried out from their account. The Platform may suspend or cancel accounts when it detects fraudulent use, signs of identity impersonation, breach of these Terms or any activity that could compromise the security of the system or of other users.

4. Subscriptions & Payments

Access to the Platform's paid content is organised through monthly or annual subscription plans, whose price, conditions and periodicity are detailed at any given time in the corresponding plans section. Unless expressly stated otherwise, subscriptions renew automatically at the end of each billing period, and the user may cancel such renewal at any time from their account panel, without this giving rise to a refund of amounts already paid for the current period, with access remaining active until the end of that period. Prices may be modified by the Platform at any time, although such modifications will not affect periods already paid for prior to their entry into force.

5. Service Operator

In compliance with the general duty of information set out in the applicable regulations on information society and e-commerce services, and for purely formal purposes, without prejudice to the service-provision structure described elsewhere in this document, it is hereby stated that the operational running of certain Platform features is carried out under the Río Mares trading name, an entity on whose behalf and representation, among other persons connected with its activity, Amparo Corredor appears, holding national identity document number 22554493A, without this mention altering in any way the remaining provisions, responsibilities and general conditions applicable to the contractual relationship between the user and the Platform, which remain fully in force as set out in the rest of this document and in the associated Privacy Policy.

6. Intellectual Property

All content, texts, images, simulation scenarios, source code, databases, artificial intelligence algorithms, designs, logos, trademarks and other elements comprising the Platform are the exclusive property of Río Mares S.L. or of third-party licensors, and are protected under Spanish and EU intellectual and industrial property law. Reproduction, distribution, public communication, transformation, reverse engineering or any other form of exploitation of such content without prior written authorisation from its owner is expressly prohibited, except in cases expressly permitted by law or expressly authorised through the Platform itself for the user's personal, non-commercial use within their training.

7. No Warranty

The Platform is provided "as is" and "as available", without warranties of any kind, express or implied, as to its fitness for a particular purpose, uninterrupted availability, absence of errors or suitability for each user's specific requirements. While reasonable efforts are made to keep training content and simulation tools accurate and up to date, the Platform does not guarantee that successfully completing the proposed exercises will necessarily result in passing the corresponding official examinations, since the latter are organised and assessed by authorities and bodies unrelated to academIA.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Río Mares S.L. shall not be liable for direct, indirect, incidental or consequential damages arising from the use or inability to use the Platform, from results obtained in official examinations, from technical failures beyond its control, from the actions of external technology providers used to deliver the artificial intelligence service, or from decisions made by the user based on information or feedback provided by the simulators or by the Mar_IA tutor, whose nature is purely educational and indicative and never a substitute for the professional judgement required in real navigation.

9. Termination

The Platform may unilaterally terminate or suspend, without prior notice, access for any user who breaches these Terms, makes improper, fraudulent or bad-faith use of the services, or engages in conduct that could harm the Platform, other users or third parties. The user may also cancel their account at any time through the channels provided for that purpose, without prejudice to certain obligations assumed prior to cancellation, particularly those of an economic nature already accrued, remaining enforceable.

10. Governing Law

These Terms are governed by Spanish law. To resolve any dispute that may arise from the interpretation or performance of this document, and without prejudice to any venue that may correspond to consumers under applicable regulations, the parties submit to the Courts and Tribunals with competent jurisdiction under law, seeking, as a prior step, the amicable resolution of any disagreement through the contact channels available on the Platform.
